Terms of Service & Privacy Policy
1. Terms of Service & Ordering
By placing an order, you agree to these terms. We reserve the right to cancel orders due to pricing errors, suspected fraud, or unforeseen inventory issues, in which case a full refund will be issued.
2. Return & Refund Policy
We offer a 30-day return initiation window with a strict 45-day receiving cutoff:
Timeline: You must initiate a standard return within 30 days of purchase. The physical item must be received by us no later than 45 days from the original purchase date.
Damaged Goods: If your artwork arrives damaged, you must report it to us within 7 days of delivery with photographic evidence of both the item and the packaging to be eligible for a replacement or refund.
Exceptions: Custom or commissioned artwork, as well as discounted/sale items, are final sale and not eligible for a standard return (the damaged goods policy still applies).
Condition & Inspection: Artwork must be in original condition. Returns rejected after inspection will not be refunded and can be shipped back at the customer's expense.
Authorization: Email breckenridge@windowslive.com with your name, SKU, and date of purchase to receive a Return Authorization (RA).
Refunds: Issued within 5 business days after inspection and approval of the returned item. Processing times may vary depending on your financial institution.
3. Shipping, Liability & Force Majeure
Costs & Risk: The customer pays return shipping unless the item arrived damaged or incorrect. Original shipping is non-refundable. Risk of loss transfers to the customer upon confirmed delivery. We are not responsible for lost outbound shipments once confirmed delivered by the carrier.
Force Majeure: Breckenridge LLC is not liable for delays or failures in performance resulting from acts beyond our reasonable control, including natural disasters, severe weather, or carrier strikes.
4. Intellectual Property & Copyright
All artwork is the exclusive intellectual property of Breckenridge LLC. All rights not expressly granted are reserved.
Restrictions: Purchase does not transfer copyright. Unauthorized reproduction, commercial use, NFT minting, or use of these images for AI training datasets is strictly prohibited.
5. Limitation of Liability
Products are provided "as-is" without warranties of any kind. Monitor calibrations vary; we cannot guarantee on-screen colors match the physical print. To the fullest extent permitted by law, Breckenridge LLC shall not be liable for any indirect, incidental, or consequential damages arising from the use or inability to use the product. Our maximum liability shall not exceed the original purchase price of the item.
6. Governing Law & Dispute Resolution
These terms are governed by the laws of the State of Colorado. Any dispute, claim, or controversy arising out of or relating to these terms or the breach thereof shall be settled by binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules, and judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. Fraudulent chargebacks will be disputed to the fullest extent of the law.
